Terms & Conditions


1.       Any variation in these conditions in a document of the customer is inapplicable unless accepted in writing by the Company.


2.       A customer who makes an order, whether verbal or written, with C W Jones Carpet & Flooring LTD hereafter referred to as the Company, shall enter into a binding contract with the Company and shall be deemed to have accepted these conditions of sale.


3.       An order can be cancelled by the customer who made it only with the agreement of the Company, and the Company reserves the right to charge a cancellation and or restocking fee.


4.       Any order cut to size or bespoke/ordered into specific requirements cannot be refunded unless agreed by the company.

5.       The prices quoted by the Company for goods ordered refer only to that particular order and do not apply if part of the order is taken, except with the agreement of the Company.


6.       Once goods have been despatched to a customer’s order, the Company will not be obliged to take them back.


7.       All balances must be paid in full prior to the installation date.    Payments can be made by calling the store or in person by credit card or debit card, or by BACS Bank Transfer to C W Jones Carpet & Flooring Limited: Sort Code: 20-13-67 Account: 00672122 if paying by bank transfer or BACS the funds must be cleared by the required dates. For orders over £500, a 50% deposit can be made to secure the goods and services. On this occasion balances are still required prior to installation date.

 

8.       The Company reserves the right to delay performance of Installations without full payment in advance until full payment is cleared.


9.       Materials and labour as supplied in accordance with the specification submitted to the customer and any additions and alternations shall be subject to be charged additionally on a time and material basis.


10.    The Company limits its liability in relation to materials supplied to that implied by law.


11.    The customer shall be deemed to have knowledge of the terms of the manufacturer’s guarantees and limitations upon liability contained therein. Details of which will be supplied by the Company upon request.


12.    A customer who has entered into a contract with the Company, shall be responsible for the moving of furniture and fittings, and the Company reserves the right to charge on a day work basis for the moving of furniture. The Company does not accept responsibility for any damage to the furniture, fittings or decorations caused by its employees, servants and agents whilst carrying out the removals.


13.    The Company accepts no liability for loss or damage caused to or by pipes, wiring, conduits, drains or other such installations both by the Company, it’s employees, servants and agents to the location and course of any such installations.


14.    Employees, servants, and agents of the Company cannot disconnect or reconnect any electrical or plumbed devices or Gas, this should be carried out by qualified tradesman.


15.    When uplifting existing floor covering, the Company cannot be responsible for any unforeseen issues beneath existing floor coverings. Any further services and materials will be considered subject to cost & availability.


16.    A customer shall not be entitled to withhold the whole part or part of payment due in consequence of any alleged defect or other claim unless notice of the alleged defect or other claim is given to the Company and the Company agrees to the retention.


17.    The Company accepts no liability for loss to the customer arising from delay in performance or non-performance of the contract to the extent that the delay or non-performance results from any cause beyond the reasonable control of the Company.


18.    All goods supplied remain the property of the C W Jones Carpet & Flooring LTD until they have been paid for in full.


19.    Please inspect the floor covering / fitting carefully and any fault must be reported to the office with 24 hours.


20.    The company does not screed or level subfloor. When preparing the subfloor with a latex smoothing compound or plyboard the company cannot be liable for the unevenness/sloping of the subfloor.


21.    On the installation of hard flooring products, the customer must make sure that the ambient temperature maintains 16°C – 28°C degrees for the product to stabilise as per by the manufacturer.


22.    If the temperatures fluctuate over 28°C the company cannot be liable for damage to the product.


23.    The company cannot be made liable for products fading in direct sunlight.


24.    For any products left with the company for over 3 months, the company cannot be responsible for loss or damage and requires goods to be delivered or collected/fitted within this timeframe.


25.    The company does not accept liability for product failure due to any subsidence in the subfloor.

 

26.    It is the customer’s responsibility to make the company aware if they have or plan to have an underfloor heating system installed prior to quoting and estimating for our works. It is also the customer’s responsibility to ensure that any underfloor heating system is fully operational, but de-commissioned 48 hours prior to and re-commissioned 72 hours after the flooring installation completed. Flooring temperature should not exceed 27 degrees, please refer to manufacturer’s instruction.

 

Uplift & disposal

When uplifting old flooring CWJones cannot be responsible for any unforeseen issues beneath existing floor coverings. Any further services will be considered subject to cost & availability.

Prior to any preparation work the floor must be free of dust, loose material and free of any moisture. Kickboards will need to be taken off prior to fitting and adapted by the kitchen suppliers/joiner if required. Toilets will need to be taken out prior to installation.

We do not disconnect/reconnect of electrical/plumbed devices or Gas this should be carried out by qualified tradesman.

 

Underfloor heating:

Underfloor heating systems must be commissioned & fully operational prior to any floor covering installation.

Temperature conditions during and after installation A constant temperature, fluctuating no more than 5°C per day, not below the required 18°C room temperature and 15°C subfloor temperature, should be maintained 24 hours before, during and 72 hours after installation.

The surface temperature must never exceed 27°C. If in doubt seek further advice. The underfloor heating installation must be switched off at least 24 hours prior to, and during the installation of your floor covering. 72 hours after installation the underfloor heating must be gradually increased by increments of 5°C per day until it reaches the standard operating temperature conditions, with a maximum operating temperature of 27°C.

Door trimming

Doors may need to be trimmed to allow clearance depending upon the depth of your chosen floorcovering. This is not part of the fitting work unless this has been specifically agreed. Fitters may remove doors to facilitate fitting and have them ready for you or your appointed carpenter to carry out the trimming and re-hanging. If you have fire doors, external doors or non-wood doors that require trimming, this will need to be carried out by a specialist carpenter and this is not a service which C W Jones will either carry out or arrange. We are also unable to remove, or arrange the removal of, any fire doors or external doors so arrangements must be made prior to the fitting date to avoid any delays.

 

Appointment times and dates

Fitting appointments are estimates only and are made in good faith, but the exact arrival and duration times cannot be guaranteed due to the nature and unpredictability of the work involved. Time is not of the essence. We cannot accept liability for delayed arrival of the fitter.

 

Damage and scuff marks

Fitters undertake to carry out their work with reasonable skill and care, but even with the greatest care home décor may be marked or scuffed during the fitting process. New paintwork and wallpaper is especially vulnerable and should be allowed to fully dry. A minimum of two weeks is recommended. Neither C W Jones nor any fitter undertake to carry out any redecoration, except where damage has been caused by that person’s negligence.

 

Payment Terms

We reserve the right to take payment in full in advance of works and prior to the ordering of materials.

For orders more than £500.00 Inc vat, you may pay in full, or we offer the option of a deposit of 50% with the balance to be paid 3 days prior to the date of installation. Payments can be made by calling your store or in person by credit card or debit card, or by BACS Bank Transfer to C W Jones Carpet & Flooring Limited: Sort Code: 20-13-67 Account: 00672122 if paying by bank transfer or BACS the funds must be cleared by the required dates. IMPORTANT NOTE: Installations will not be completed without payment. Unfortunately, we do not accept AmEx.

For projects requiring ‘phased works’ for example multiple areas being completed over a longer period, payments for all following phases must be paid at the completion of the first phase, (unless otherwise agreed in writing in advance) This covers the cost of materials and the safe storage of the same over longer periods.

 

Delay of Goods & Services

Unfortunately, if you cancel an order for goods and we have already dispatched your goods to you, we will not be able to cancel your order until it is delivered or collected. In this case, if you return the goods to us, we reserve the right to levy any reasonable additional cancellation or restocking charges we think fit (these are often enforced by our manufacturers or suppliers). This will not affect your refund for the goods, but any charge for collection will be deducted
